TERMS & CONDITIONS

FESTIVAL TICKETS

  1. Borderland Music Festival and events produced by Borderland Music Festival will happen whether rain or shine.

  2. Tickets are non-returnable.

  3. Borderland Music Festival cannot accept responsibility for unused tickets.

  4. Tickets are considered forfeited if not used/redeemed at the event they were purchased for.

  5. Refunds may be made available in the instance the event is cancelled without being rescheduled.

  6. Artist line-up, set times, performers and advertised attractions are subject to change, and no refunds will be offered if any performances are cancelled. 

  7. Our authorized ticket seller is ZCITY.

  8. Tickets may be purchased directly from ZCITY.

  9. Tickets purchased from unauthorized sales channels (e.g., scalpers or resale sites) or third parties may be forged, and in this case would not be honoured or eligible for a refund. If you do choose to purchase from a third party, you assume full responsibility for ensuring your ticket is valid. You may email us before exchanging money to confirm a ticket is legitimate. 

  10. Once you purchase your ticket you will receive an order confirmation email from ZCITY on behalf of Borderland Music Festival.

  11. You will exchange your printed ticket or scan your mobile ticket in exchange for your wristband at ticketing counter upon arriving at the Festival.

  12. You will not be allowed to enter any festival events unless wearing your own, valid wristband.

  13. Festival wristbands must be worn at all times and must not be tampered with. Tampering with your wristband may deem it void and result in you being removed from the festival or required to purchase a new ticket. 

  14. There will be no automatic right of re-admission during the Festival should the wristband become lost, stolen, destroyed or damaged and you unconditionally accept the risk of damage to, loss of and/or theft of your band. Your wristband is not redeemable for cash.

  15. Anyone caught forging entry tickets, wristbands or any other special admission tickets in order to access the Festival or sell such tickets for the festival will be prosecuted without exception.

AT THE FESTIVAL

  1. The Promoter reserves the right to refuse admission to the Festival. It is a condition of entry to the Festival that you will submit to any reasonable search request or search policy in place.

  2. During the Festival, you must be able to provide valid identification if requested by a member of security or crew.

  3. Patrons will not be permitted entry to the Festival whilst in the possession of the following prohibited items: items that may be used in a dangerous or threatening manner, firearms, knives or weapons of any description (and any other sharp items), glass bottles (please decant into other containers), illegal drugs, fireworks or explosives.

  4. The Festival cannot accept liability for any confiscated items – please inquire with us before you bring anything you feel may be confiscated.

  5. Illegal substances are strictly prohibited at the Festival. Any person found in possession of such substances will be denied entry and / or removed from the Festival, and Police may be called to attend.

  6. To ensure the safety of all festival attendees, access to the event sites will be refused to, but not limited to, people who:

• are under the influence of illegal drugs or any other illegal substances

• are clearly suffering from alcohol or other substance intoxication

• have been previously banned from festivals and/or other events by the organizer, the administration or legal authorities

• are demonstrating an intent to disturb the peace or to provoke someone else to do so

• engage in fighting or any disruptive behaviour

• resist the direction of and searches by the Festival’s security guards

  1. At the Festival, it is forbidden to try to access sections restricted to artists or Festival staff – such as production rooms, green rooms, press rooms, offices, backstage and working areas – unless in accordance with your ticket or credentials. Trying to access these areas may result in your removal from the event and/or exclusion from future events. 

  2. At the Festival it is forbidden to obstruct entrances, exits and evacuation routes and/or to linger at these locations any longer than strictly necessary for entering or exiting the Festival site. It is also forbidden to deface, mark, damage, tear down or otherwise destroy, in whole or in part, any of the decorations or part of the Festival site. Engaging in such behaviour may result in your removal from the event and/or exclusion from future events.

PHOTO / VIDEO POLICY

  1. By attending Borderland Music Festival and events produced by Borderland Music Festival, you consent to being filmed and or photographed, whereas your image, voice, and likeness may be used by the Festival for promotional purposes. 

  2. Any photography or video taken at these events, whether in digital or analog format, is subject to a mandatory, non-exclusive license to Borderland Music Festival for use in promotional purposes. Any artwork or performances sponsored by the Festival or taking place on Festival grounds is also subject to a mandatory, non-exclusive license to Borderland Music Festival for use in promotional purposes. The “Footage” may also be used by or on behalf of the Company or any of the Company’s subsidiaries, affiliates, partners, sponsors, officers, shareholders, successors or assigns for any purpose, including, but not limited to, archival, promotional, and commercial purposes, without any compensation to you. You waive all other rights in the Footage, including, but not limited to, all claims of so-called moral rights. This Footage may also be used as a means to identify and facilitate the prosecution of illegal or impermissible conduct.

  3. All photographers using professional equipment (ie DSLR / anything with a detachable lenses) are required to have media credentials to take pictures or video at the Festival.

  4. Attendees may take photos and shoot video for personal, non-commercial use, with personal cameras (excluding SLR/DSLRs) as long as they are not standing in the press area, obstructing views, using any sort of device like a tripod or selfie-stick. Any recordings made by ticket holders on or near the Festival site may not be used for commercial or public purposes, unless consented to by the Company.

  5. DRONE use is prohibited without specific written permission from the Festival. Please keep them packed away, if we see you using it, we may confiscate it and hold it for the remainder of the event.

  6. Unauthorized photography or audio/video recording of any performance at the Festival is strictly prohibited. The Festival cannot accept liability for any damages, loss or injuries sustained at the Festival, including loss or damage to property, however caused.

PARKING

  1. The Festival disclaims all responsibility from losses or damages to vehicles parked in or near the Festival. The Festival is not responsible for losses or damage to any vehicle on or near the Festival, including, without limitation, vehicles towed from the Festival site.

MEDICAL CARE

  1. In the event of a medical emergency, you hereby consent to medical care and transportation at your cost in order to obtain treatment that is deemed reasonably appropriate or necessary by the reasonable discretion of the Festival staff, security, police or medical professionals.

  2. You hereby agree to release and not hold responsible the Borderland Music Festival from any liability arising out of, or in connection with, the actions or omissions of the Borderland Music Festival related to your medical care.

  3. You recognize and acknowledge that there are hazards and risks of physical injury or illness and that not all such risks can be fully eliminated.

  4. You understand this waiver extends to any liability that arises out of, or is in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury.

  5. By entering the Festival site, you voluntarily agree to assume the full risk of death, bodily injury or property damage, regardless of severity, that may be sustained as a result of attendance at the Festival or while on the premises, whether or not caused by the negligence or gross negligence of the Festival Parties.

WAIVER

  1. By entering the Festival, you assume any and all risk and/or danger, known or unknown, foreseeable and unforeseeable, resulting from, or incidental to, the Festival, whether occurring prior to, during, or subsequent to, the Festival, including, but not limited to, any death, personal injury or loss, damage or liability whatsoever. You understand that your use of your ticket is contingent upon your voluntary assumption of the risk and danger that may result from, or be incidental to, your presence at the Festival, whether occurring prior to, during or after the Festival, including any actions or omissions of the Festival Parties.

  2. By entering the Festival, you acknowledge and agree that you may be subject to extremely loud music and sounds, as well as special effects, including, but not limited to, laser lights, strobe lights, flashing lights, a variety of light emitting diodes (“LED”), rapidly changing or alternating images, and use of smoke, fog, and pyrotechnics (collectively, the “Special Effects”) at the Festival.

  3. You acknowledge and understand that the Ticket is a revocable license to attend the Festival for which it was issued, and is subject to revocation and denial of admission without compensation for any reason, including, but not limited to, your attempted or actual violation of any of the rules set forth herein, policy or regulations and for any other action taken by you in violation of any local, state or federal law, or that may endanger other Ticket Holders.

INDEMNIFICATION

  1. You hereby indemnify and not hold responsible the Company, its parent, affiliate, and subsidiary companies, and each of their respective representatives, officers, directors, owners, members, trustees, agents, employees, successors and assigns, including the owners of the venues where the Festival events take place, the ticket agent(s), festival sponsors, the promoter(s), and the performing artists, including their respective management, agents, staff and designees (collectively, the “Company Parties”) from any loss, liability, damage or cost in any way arising out of or related to, your actions and omissions at, around, or while traveling to and from, the Festival.

  2. You hereby waive, discharge, hold harmless and covenant not to sue the Company Parties from any and all liability arising out of or in connection with the Festival, for any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or experiences of whatsoever kind, nature, or description arising out of, or related to the Festival, your attendance at the Festival, or your travel to and from the Festival, whether or not caused by the negligence or gross negligence of the Company Parties.

  3. For safety reasons, the Company reserves the right to, without any prior notice or compensation to you: (i) postpone, cancel, interrupt or stop the Festival; (ii) provisionally keep visitors on the Festival site at the end of the Festival; (iii) totally or partially vacate the Festival site; and (iv) deny access to the Festival site regardless of the possession of a Ticket.

  4. The Company reserves the right to change, modify, or alter any aspect of the Festival (including, without limitation, the appearance of any performer or artist, and/or the order of performance of any performer or artist), at any time, for any reason whatsoever, without any prior notice or compensation to You. You understand that the artists and/or line up for the Festival may be changed and that such occurrence shall not, under any circumstances, entitle You to any claim whatsoever, including, but not limited to, a refund for Your Ticket

  5. You understand, acknowledge and agree that the names of any artist, act or performer contained in any Festival promotional material is intended for informational purposes only, and does not, in any way, represent the importance or headline status of any single artist, act or performer, and is subject to change without prior notice.

FORCE MAJEURE

  1. If the Festival is cancelled in whole or in part due to a Force Majeure Event, you will not be entitled to a refund. Notwithstanding the foregoing, the Company may issue, at the Company’s sole and absolute discretion, a partial or full refund of your Ticket, by accounting for, among other considerations, the extent and nature of the cancellation.

  2. A “Force Majeure Event” shall mean an act of God, act of terrorism, flood, hurricane, tsunami or other natural disaster, war, strike or other labor condition or dispute, an order or injunction of any court or administrative body or any other act of public authority, severe weather threatening the safety of Festival attendees or similar contingency or unexpected event, and any such occurrence beyond the reasonable control of the Company. You understand that in all instances, the maximum remedy You may receive for the cancellation of any part of the Festival, if any, will be the face value of Your Ticket, excluding all fees and/or service charges paid by You in connection with the purchase of Your Ticket.

PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://www.borderland-asia.com/ and ZCITY (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or forms that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. EMAIL NEWSLETTER

  1. We operate an email newsletter program, used to inform subscribers about products and services supplied by this website. Users can subscribe through an online automated process should they wish to do so but do so at their own discretion. Some subscriptions may be manually processed through prior written agreement with the user. Email marketing campaigns published by this website or its owners may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include; the opening of emails, forwarding of emails, the clicking of links within the email content, times, dates and frequency of activity among other information as needed. This information is used to refine future email campaigns and supply the user with more relevant content based around their activity.

  2. Subscribers are given the opportunity to un-subscribe at any time through an automated system. This process is detailed at the footer of each email campaign. If an automated un-subscription system is unavailable clear instructions on how to un-subscribe will by detailed instead.

Authorised seller (Agent) T&C (Terms of service, Privacy policy)

  1. Borderland Music Festival appoints the Authorized Seller as an exclusive Authorized Seller for the sale of its ticketing sales on a commission basis. The Authorized Seller agrees to promote, market, and sell Borderland Music Festival's ticket within the designated territory.

  2. The Authorized Seller will be entitled to receive a commission on the net sales value of the ticketing sold for the referral code entered by buyer. Any wrong referral code entered wrongly will be deemed void. The commission rate and payment terms shall be agreed upon separately in writing between the Authorized Seller and Borderland Music Festival.

  3. Obligations of the Authorized Seller:

    • The Authorized Seller shall promote and sell Borderland Music Festival’s ticket in a professional manner, adhering to the Borderland Music Festival’s branding and marketing guidelines.

    • The Authorized Seller shall provide accurate and up-to-date information about the music festival to potential customers, including any updates, features, and pricing.

    • The Authorized Seller shall promptly report all sales made and provide necessary documentation as requested by Borderland Music Festival.

    • The Authorized Seller shall comply with all applicable laws and regulations relating to the sale and marketing of the ticket sales.

  4. The Authorized Seller shall keep all confidential information received from the Company, including DJ line up, pricing details, and trade secrets, strictly confidential and shall not disclose such information to any third party without the prior written consent of Borderland Music Festival.

  5. Intellectual Property: The Authorized Seller acknowledges that all intellectual property rights related to Borderland Music Festival’s goods, including trademarks, copyrights, and patents, are the exclusive property of Borderland Music Festival. The Authorized Seller shall not use, reproduce, or modify such intellectual property without the express written consent of Borderland Music Festival.

  6. This terms and conditions constitute the entire agreement between the Authorized Seller and Borderland Music Festival and supersedes all prior agreements, understandings, and representations, whether written or oral, relating to the subject matter hereof.
